(Hereinafter only “DV”).

 

2. Scope

 

Thedesertsisters Festival (hereinafter only “Festival”) takes place in the desert camp Bivouac les Nomades. The festival ticket itself is for free! By booking a ticket, you agree to cover the costs of your stay at our partner Bivouac les Nomades. All payments go directly to Bivouac les Nomades.

 

3. Conclusion of contract

 

3.1. The tickets are purchased through the third-party provider or through DV directly.

The contract for participation in the festival is formed with DV when the visitor(s) has received an e-mail confirming the purchase. The order confirmation e-mail also contains an attachment via which the purchased ticket can be called up in electronic form and printed out.

 

3.2. DV is entitled to withdraw from the contract with the visitor if the visitor violates any part of the contract.

 

3.3. It is not possible to return tickets - they can be passed on to suitable visitors in consultation with DV.

 

 

4. Resale Prohibitions, Prohibition on Modification of Tickets

 

4.1. The visitor is obliged to purchase and use the tickets exclusively for private purposes. 

Any industrial or commercial resale/passing on of the purchased tickets is only permitted with the consent of DV. If visitors come to the festival without prior consent, access may be denied

 

 

4.2. The resale / transfer of tickets requires the consent of DV if the visitor transfers the right to visit to the third party, i.e. if the third party assumes all rights and obligations arising from the contract.

 

 

5. Access to thedesertsisters festival

 

5.1. Access to thedesertsisters festival is only permitted to visitors who have a valid ticket and are over the age of 16. Tickets will be checked when the festival shuttle departs for the festival site.

The ticket and the valid passport must be shown.

 

5.2. DV reserves the right to deny visitors access to the festival site for important reasons. In this case, the visitor's ticket loses his/her and the ticket price will not be refunded. Whether a stay in the camp is still possible is up to our partner Bivouac les Nomades

 

5.3. The festival site is a desert camp - for your own safety, the instructions of the staff must be followed at all times.

 

5.4. Removal from the festival site into the open desert is prohibited.

 

6. Payment at the festival

 

Only cash payments in the local currency (Moroccan Dirham) are accepted on the festival site.

It is advisable to have enough cash available before arrival as there is only one ATM in the area.

 

7. Prohibited Items/Admission Control

 

7.1. Dangerous items are prohibited on the festival site, such as drugs, alcohol, weapons.

Animals may not be brought onto the festival site.

 

 

8. House rules / rules of conduct / photography and filming

 

8.1. The domiciliary rights are exercised by DV or by commissioned third parties, in particular to the operators of the desert camp

 

8.2. In particular, visitors are prohibited from:

 

8.2.1. to carry prohibited objects within the meaning of Section 7.1;

 

8.2.2. urinating or defecating outside of the toilet;



8.2.3. Commercial trading, marketing campaigns or advertising measures, such as advertising a product, a service, a company or a brand, as well as the attachment of decorations and other objects are prohibited on the entire festival site without the written consent of DV.

 

8.2.4. To enter areas and rooms that are not open to visitors, e.g. the kitchen and bedrooms of the nomads

 

8.3. Photography and video recordings for private use are permitted, whereby the personal rights of third parties must be observed. If you use it on social media, we ask you to mark it. Excluded from this are recordings from the workshops that show personal and vulnerable moments of the participants. In addition, the nomads may only be photographed with prior expressed permission – cultural photographs are not particularly popular with women.

 

8.4. Removal from the festival site into the open desert is prohibited.

 

8.4. If visitors violate these rules of conduct, DV can be expelled from the festival site and banned from the premises. The return transport to the next town is at the expense of the visitor (pprox.. 100€). If possible you can stay at the camp, without participating any activities of the festival

 

9. Cancellation, termination or change in the implementation of the event/force majeure

 

9.1. If the event is canceled, aborted or changed due to events that are demonstrably outside of DV's sphere of influence, such as e.g. B. Force majeure (in particular acts of terrorism, attacks, threats of attacks, war, visitor wars or war-like events, strikes, lockouts, industrial unrest, riots and/or civil unrest, storms, floods, pandemics/epidemics) and/or in the event of a official cancellation due to the aforementioned or other events, the following clause 9.2 applies.

 

9.2. In these cases, the parties are released from their respective contractual obligations. The visitor's claim for reimbursement is based on the statutory provisions. Each party bears its own costs. Any claims for damages or reimbursement of expenses are excluded.

If possible, DV will suggest an alternative date on which the tickets already purchased are valid.

 

9.3. Changes to the festival schedule due to desert-specific events, e.g. sandstorms, are to be accepted by the visitors. DV offers alternatives within the scope of the possibilities. In this case, follow the instructions of DV and the local nomads

 

10. Liability

 

The liability of DV, its legal representatives and vicarious agents is fundamentally excluded. This does not apply to damage resulting from injury to life, limb or health, as well as liability under the Product Liability Act and liability for a fraudulently concealed defect or the assumption of a quality guarantee. The exclusion also does not apply to damages based on an intentional or grossly negligent breach of duty by DV, its legal representatives or vicarious agents. Otherwise, DV is liable for damage resulting from the breach of an obligation that is of essential importance for the achievement of the purpose of the contract, the fulfillment of which is essential for the proper execution of the contract and on compliance with which the visitor trusts and trust (essential contractual obligation), limited to the contract-typical, foreseeable damage.

 

Liability for damage caused by the conditions in the desert is excluded, e.g. damage to electronic devices (e.g. mobile phones) due to sand and heat.

 

11. Data protection, rights to one's own image, image, video and sound rights

 

By booking/participating in the event, the customer agrees that photos and/or videos may be taken of him during the event and that these photos and videos with his picture may also be edited by the organiser, the camp operator and the team members involved in connection with reporting on the event or to advertise the event and/or in particular via digital and social media channels may be used for all types of use without any spatial or temporal restrictions.

 

12. Shuttle to the festival site

 

All visitors will receive precise information in advance about the departure time and place of transport to and from the camp. The visitors are responsible for being on time at the specified departure point. A later arrival and earlier departure is possible at your own expense (approx. 100 € per route, per vehicle).

The shuttle only includes transport from Foum Zguid to the camp and back. Visitors are responsible for their own travel to Foum Zguid.

 

13. Invalidity of Individual Provisions

 

The invalidity of individual provisions of the General Terms and Conditions or the contract does not result in the invalidity of the entire contract.

15. Miscellaneous

 

Online dispute resolution in accordance with Art. 14 Para. 1 ODR-VO and §36 VSBG: The European Commission provides a platform for online dispute resolution (OS), which you can find at ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
